Seniors deciding on a 55+ community together

55+ Community Due Diligence Guide: Questions to Ask Before You Move

Moving to a 55+ community can be an exciting change. It also comes with more rules than most buyers expect. Before you sign anything, use this due diligence guide to get a clear picture of what the community expects of you and what you can expect in return.

Is Your 55+ Community Legal?

Here is a fact many buyers miss. A 55+ community is legal only if it meets the federal requirements of the Housing for Older Persons Act (HOPA). In general, at least 80% of the occupied homes must have a resident who is 55 or older. The community must also publish and follow policies that show it is meant for older adults. You can read the details from HUD.

Ask every community you visit how it meets these rules. A good community will answer clearly.

Age Restrictions and Occupancy Rules

Start with who can live in the home. These answers shape your daily life and your plans for the future.

  • Does at least one permanent resident meet the 55+ age requirement?
  • What is the policy for spouses or partners under 55?
  • What are the rules for adult children (18+) or extended guest stays?
  • What is the community’s policy if the qualifying senior passes away?

Fees and Amenities in a 55+ Community

Fees vary widely from one community to the next. Get the numbers in writing, and find out exactly what they cover.

  • What is the monthly or quarterly association fee?
  • Which amenities are included (lawn care, roof repair, clubhouse, gym)?
  • Are any amenities subject to separate membership fees (e.g., golf)?

Lifestyle, Restrictions and Future Sales

Every 55+ community has its own rulebook. Read it before you fall in love with a floor plan. These rules also affect who can buy your home when you sell.

  • Pet restrictions (weight limits, breed bans, maximum number of pets)
  • Parking guidelines (RV/boat storage, garage access, street parking)
  • Architectural guidelines for personal modifications or gardening
  • Rental caps or subletting rules if you plan to travel seasonally

Healthcare and Future Planning

Plan for the life you want now and the one you may need later. A great 55+ community should make both easier.

  • Is independent or assisted living available on-site if your needs change?
  • How far are the nearest emergency medical facilities and hospitals?
  • Are local community shuttle services available for medical and/or leisure outings?
